It is an indisputable fact that the internet is the greatest and most important achievement of modern science. Information and communication technology has achieved multiple benefits in the field of human advancement and progress in most aspects of economic, educational, medical and judicial life. The Internet and cyberspace have created a number of new challenges and threats without due consideration to the geographic location or sovereignty.
The world has witnessed and experienced this information revolution, with its meaning of ease and speed in the transmission of information through the event that swept the world with the spread of coronavirus (COVID-19), and without the internet, life would have stopped, but this technology allowed the members of societies to continue the wheel of life in various fields, such as distance education, e-learning and remote litigation... etc., which had a positive impact on members of society.
There is no doubt that the internet is considered a double-edged sword, either to be used positively or negatively, because even though the many benefits of the internet that it creates to people, nevertheless it has negative effects and disadvantages on their life, as these disadvantages have been represented in the emergence of a number of experienced weak-minded people that are professionals in adapting this technology to carry out criminal acts represented in spreading false rumors and spreading bad habits and encouraging them.
It is well known that any technical development has repercussions and impact at various levels generally and particularly within the framework of criminal law, as all modern inventions require legal protection, and the UAE legislature has accompanied this development by developing laws that strive to and prevent cybercrime in light of what the United Arab Emirates has witnessed of the increasing use of the Internet in order to confront electronic crimes and for protecting society from its dangers and threats.
In order to protect the rights and privacy of individuals, the UAE legislature has issued the UAE Federal Law Number 5 of 2012 on Combating Information Technology Crimes (Cyber Crimes Law), which its articles kept pace with the modern development regarding the protection of rights, for instance:- Article (7) of the above mentioned law stipulates that: "Shall be punished by temporary imprisonment whoever obtains, possesses, modifies, destroys or discloses without authorization the data of any electronic document or electronic information through the computer network, a website, an electronic information system or information technology means where these data or information are related to medical examinations, medical diagnosis, medical treatment or care or medical records.".
Article (12/1) also stipulates that: "Shall be punished by imprisonment and a fine or either of these two penalties whoever gains access, without legal right, to credit or electronic card numbers or data or to bank accounts numbers or data or any other electronic payment method by using the computer network or an electronic information system or any information technology means.".
Article (16) of the above mentioned also law stipulates that: "Shall be punished by imprisonment for a period of two years at most and a fine not less than two hundred fifty thousand dirhams and not in excess of five hundred thousand dirhams or either of these two penalties whoever uses a computer network or information technology means to extort or threaten another person to force him to engage in or prevent him from engaging in a certain act. The punishment shall be imprisonment up to ten years if the subject of threat is to commit a felony or engage in matters against honor or morals.".
- We find that the UAE legislature has been concerned with protecting the privacy and reputation of individuals, as Article (20) of the above mentioned law stipulates that: "Without prejudice to the crime of slander determined by the Islamic Sharia, shall be punished by imprisonment and a fine not less than two hundred fifty thousand AED and not in excess of five hundred thousand AED or either of these two penalties whoever insults or accuses another person of a matter of which he shall be subject to punishment or being held in contempt by others, by using a computer network or an information technology means. If a slander or insult is committed against a public official or servant in the course of or because of his work, this shall be considered an aggravating factor of the crime."
Finally, the UAE legislature made the penalty of imprisonment for a period of no less than one year in accordance with the Duplicate Article (198) of the Federal Penal Code (Criminal Law) concerning anyone who spreads false rumors.
